Please read this page carefully. It governs your use of the Listeners Connect platform.
Listeners Connect Terms of Service Overview
Welcome to the Listeners Connect app, managed by ListenersConnect. These Terms of Service ("Terms") provide the rules and regulations for using both the Listeners Connect website and the mobile application (collectively referred to as "Listeners Connect" or the "App"). By accessing, viewing or using Listeners Connect App, you agree to comply with these Terms, which govern your interactions with the platform and its services. Before accessing or using our services, please take a moment to thoroughly read these Terms. We also encourage you to review our Community Guidelines and Privacy Policy, which form an integral part of these Terms.
Automatic Subscription Renewal
If you subscribe to any Listeners Connect services for a specific period (the "Initial Term"), your subscription will automatically renew for additional periods of the same duration at the then-current fee unless you cancel the subscription as detailed in Section 5 below. It is important to note that subscription terms will be subject to automatic renewal unless explicitly canceled.
Refund & Cancellation Policy
All purchases made on the Listeners Connect app are final. Listeners Connect offers real-time, on-demand services—such as voice calls, video calls, and chat consultations—where the value is delivered instantly once a session begins. Therefore, we do not provide refunds, returns, or cancellations for any completed or ongoing consultations, irrespective of duration or outcome. Users are advised to review expert profiles, pricing, and availability before initiating a session. In cases of technical errors or failed session initiation where no service was delivered, Listeners Connect may, at its sole discretion, review the issue and provide a resolution that may include credit adjustment to the user's wallet. No monetary refunds will be issued under any circumstances.
Arbitration Agreement
Please be aware that Section 13 of these Terms contains provisions about how disputes between you and ListenersConnect will be resolved. In particular, it includes an arbitration agreement that, with limited exceptions, requires disputes to be resolved through binding and final arbitration. You have the option to opt out of this arbitration agreement following the instructions outlined in Section 13. If you choose not to opt out, you agree that (1) any disputes will be resolved individually, and (2) You waive your right to file claims in a court of law or to request a jury trial.
Cancellation and Refund Policy for California Subscribers
Subscribers in California have the right to cancel their subscription without any fees or obligations before midnight on the third business day following the subscription date. If you subscribed via an external service like Apple ID or Google Play, you must cancel directly through that service. If your subscription was through Apple ID, any refund requests must be processed by Apple, not Listeners Connect. Refund requests can be initiated through your Apple ID account on your device or by visiting Apple Support.
For all other users, you may request a refund by contacting Listeners Connect's Customer Service via our Help Center. Alternatively, you can send a signed and dated notice indicating that you are canceling your subscription to ListenersConnect. Please include your name, email address, phone number, or any other unique identifier used to create your Listeners Connect account. Please thoroughly review the Dispute Resolution provisions outlined in Section 15 below. These sections detail how any disagreements between you and Listeners Connect will be addressed. The Dispute Resolution provisions include a required informal dispute resolution process before arbitration (excluding individual claims of sexual assault or sexual harassment related to your use of the Services). Additionally, there is an arbitration agreement, an option to file in small claims court, a class action waiver, special procedures for mass arbitration filings, and a jury trial waiver, all of which could impact your legal rights. Arbitration typically involves less discovery and limited appellate review compared to court proceedings.
We reserve the right to update these Terms periodically, so we encourage you to check this page regularly for any changes.
Account Registration and Use
Before using the Listeners Connect app, you must register for an account ("Account"). To create an Account, you must:
Be at least 18 years old or the age of majority as required by the laws of your country of residence if it is greater than 18; and be legally allowed to use the App according to the laws of your country of residence.
Please note that we monitor for underage users, and we will terminate, suspend, or request verification of your Account if we suspect that you may be underage.
You can create an Account manually or by using your Google or Apple login credentials. If you create an Account using your Google or Apple ID, you authorize us to access, display, and use certain information from your account (e.g., profile pictures, location, and other relevant information). For more details about the information we use and how we use it, please refer to our Privacy Policy.
You are not allowed to use another person's Account or share your Account with anyone else without permission.
If you wish to leave Listeners Connect, you can delete your Account at any time by going to the 'Settings' page and selecting the 'Delete account' option. Your Account will be deleted immediately, but it may take some time for all your content to be fully removed from the App. If you delete your Account and try to create a new one using the same credentials within this period, we will reactivate your previous Account.
Account Termination and Suspension
We use a combination of automated systems, user reports, and a moderation team to monitor accounts and content for any violations of these Terms. Listeners Connect reserves the right to terminate or suspend any Account, restrict access to the App, or take other legal or operational measures as necessary to enforce these Terms, including blocking specific IP addresses.
For users residing in the European Union ("EU"), we will notify you if we take action against your Account or content unless restricted by law enforcement. For all other users, we may take such action at any time without liability and without prior notice. We explicitly reserve the right to terminate or suspend your Account without notice for any of the following reasons:
Violation of these Terms; Inappropriate conduct on the App or with other users (including offline conduct); Inappropriate conduct on other apps operated by our affiliates; Any other reasons we deem, at our sole discretion, justify termination.
If your Account is terminated or suspended, you agree that you will not receive a refund for any paid services or features. If you believe that we have made an error in taking action against your Account, you can appeal through the process outlined in the app or by contacting us directly.
For users in the EU, you have additional rights under the Digital Services Act, including the right to access third-party dispute resolution, seek remedies from local courts, or lodge a complaint with your local EU regulatory authority. For users in the UK, you have the right to bring a claim for breach of contract under local law if you believe we have violated these Terms by removing or limiting access to your content, or by suspending or terminating your account.
You are prohibited from accessing or tampering with non-public areas of the App or our systems. Some parts of the App may not be accessible unless you have registered for an Account.
Account Eligibility and User Responsibilities
Before creating an account on Listeners Connect, please ensure that you meet the eligibility requirements. This section outlines who can use Listeners Connect's services and the responsibilities you agree to when using our platform. By accessing Listeners Connect, you represent and warrant that:
You are an individual (i.e., not a corporation, partnership, or other business entity) who is at least 18 years old. You are legally able to enter into a binding contract with ListenersConnect. You are not residing in a country that is under a U.S. Government embargo, nor are you in a country identified by the U.S. Government as supporting terrorism. You are not listed on any U.S. Government restrictions list, including the U.S. Treasury Department's Specially Designated Nationals list or any other similar prohibited parties list. You are legally permitted to use our Services. You have not been convicted of, or pled no contest to, a felony or similar serious offense, a sex crime, or any crime involving violence unless you have received clemency for a non-violent crime and ListenersConnect has determined that you do not pose a threat to other users. You are not obligated to register as a sex offender under any state, federal, or local registry. You do not have more than one account on our Services. You have not been previously removed from Listeners Connect or any affiliated services unless you have our express written permission to create a new account.
If you no longer meet these requirements, you must immediately delete your account, and ListenersConnect reserves the right to revoke your access to our Services without warning.
Mental Health and Emergency Disclaimer
ListenersConnect provides access to coaching, listening, and advisory services for informational, emotional, and educational purposes only. The Services are not intended to be, and do not constitute, medical advice, psychiatric care, clinical therapy, diagnosis, or treatment of any mental or physical health condition.
You understand and agree that Listeners Connect is not a crisis intervention platform and does not provide emergency services. If you are experiencing a medical emergency, mental health crisis, or suicidal thoughts, you must immediately contact local emergency services, a licensed mental health professional, or a suicide prevention hotline in your region.
To the fullest extent permitted by law, ListenersConnect, its affiliates, employees, contractors, coaches, consultants, or listeners shall not be held liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to bodily injury, emotional distress, death, or harm arising from or related to your use or misuse of the Services, including any interactions with coaches, consultants, listeners, or other users of the Listeners Connect platform.
You acknowledge that your use of the Services is entirely voluntary and at your sole risk. ListenersConnect does not guarantee any outcome or result from the use of its Services.
Your Responsibilities
By using Listeners Connect, you agree to:
Comply with these Terms and regularly check this page for any updates. Follow all applicable laws, including privacy laws, intellectual property laws, anti-spam regulations, and any other relevant legal requirements. Use the latest version of the Listeners Connect app and/or website. Review and follow our Safety Tips. Adhere to our Community Guidelines, which may be updated from time to time. Take appropriate measures to safeguard your login details and ensure their security.
You also agree that you will not:
Provide false information about your identity, age, or any connections to individuals or organizations. Use Listeners Connect in a way that damages the Services or disrupts the experience for other users. Engage in activities that interfere with, disrupt, or negatively impact the platform, servers, or networks associated with Listeners Connect. Use Listeners Connect for any harmful, illegal, or fraudulent purposes, including but not limited to money laundering or financial crimes. Harass, bully, stalk, intimidate, assault, defame, or otherwise harm or cause psychological distress to others. Share or upload any restricted content (as outlined below). Request passwords or personal details from other users for illegal or business-related reasons. Ask other users for money, gifts, loans, or any kind of compensation. Use another user's account or share your account without permission. Use Listeners Connect in relation to any fraud, pyramid scheme, or similar practice. Use Listeners Connect for any political campaign financing or election influence, other than sharing personal political opinions. Violate the license granted to you by Listeners Connect (see Section 6). Reveal confidential or proprietary information that you are not authorized to share. Copy, modify, distribute, or create derivative works from any member content or Listeners Connect's content, including copyrighted material, trademarks, or proprietary information without ListenersConnect's prior written consent. Suggest or claim that any of your statements are supported or approved by Listeners Connect. Use any automated means, such as bots or crawlers, to access or retrieve data from Listeners Connect. Upload viruses, malware, or other malicious code that could compromise the security of Listeners Connect. Falsify headers or alter identifiers to obscure the source of any data sent via Listeners Connect. Frame or mirror any part of Listeners Connect without prior written authorization from ListenersConnect. Use meta tags or code containing references to Listeners Connect or its trademarks to direct traffic to other websites for any purpose. Modify, adapt, sublicense, translate, sell, reverse engineer, decompile, or disassemble any portion of Listeners Connect's Services. Use or develop third-party applications that interact with Listeners Connect without our written consent. Use, access, or publish Listeners Connect's application programming interface (API) without our written consent. Probe, scan, or test the vulnerability of Listeners Connect's systems or networks. Promote or participate in actions that breach these Terms. Create a new account after your previous account has been suspended or terminated unless you have received express permission. Submit false or misleading reports about another member's behavior or content, or abuse Listeners Connect's reporting system.
The license granted to you under these Terms and your authorization to access Listeners Connect is automatically revoked if you engage in any of the above activities.
Prohibited Content
Listeners Connect prohibits the uploading or sharing of content that:
Could reasonably be deemed offensive or harmful, causing psychological distress to others. Includes content that is obscene, pornographic, violent, or contains nudity. Is abusive, threatening, discriminatory, or promotes racism, sexism, hatred, or bigotry. Encourages or facilitates illegal activities, including terrorism or inciting racial hatred. Promotes self-harm, eating disorders, or other harmful behaviors. Is defamatory, libelous, or untrue. Relates to commercial activities such as sales, promotions, or advertising, including "sugar daddy" or "sugar baby" relationships. Involves the transmission of spam or malware. Contains spyware, viruses, or other malicious code designed to disrupt or damage software, hardware, or telecommunications. Infringes upon the intellectual property or privacy rights of others. Was not created by you unless expressly authorized by Listeners Connect. Includes the image or likeness of another person without their consent, or in the case of minors, without the consent of their parent or guardian. Depicts or implies minors engaged in sexual activity or other inappropriate behavior. Is inconsistent with the intended use of Listeners Connect's Services. May harm the reputation of Listeners Connect or its affiliates.
Sharing or posting restricted content can lead to the immediate suspension or termination of your account.
Types of Content
On the Listeners Connect app, you will encounter three main types of content:
Your Content: This is the content that you upload and share on Listeners Connect. Member Content: This refers to content shared by other users on Listeners Connect. Our Content: This is the content provided by ListenersConnect, including but not limited to databases, software, graphics, trademarks, and other intellectual property.
Content Guidelines and Restrictions
At Listeners Connect, we encourage users to express themselves freely; however, we must enforce certain restrictions on content to maintain a safe and respectful environment. The Listeners Connect Community Guidelines, which form part of these Terms, outline acceptable content and behavior both on and off our platform. You agree to comply with these guidelines, which may be updated periodically.
The following types of content are strictly prohibited on Listeners Connect:
Content that violates the law or encourages, supports, or incites illegal actions. Content that is harmful to minors. Defamatory or libelous content. Content that infringes on the rights of third parties, including intellectual property and privacy rights. Content depicting another person that was created or distributed without their consent. Language or visuals that may be considered offensive, or that harass, disturb, embarrass, alarm, or irritate others. Content that is obscene, sexually explicit, violent, or offensive to human dignity. Content that is abusive, threatening, discriminatory, or promotes racism, sexism, hatred, or bigotry. Commercial content, including but not limited to sales, promotions, advertising, and solicitation of services. Spam or junk mail. Content intended to deceive or manipulate others, including scams or inauthentic behavior. Content containing spyware, adware, viruses, or other malicious code designed to disrupt or damage software, hardware, or telecommunications networks. Any content or material that does not comply with our Community Guidelines.
Your Content
You are responsible for the content you upload to Listeners Connect ("Your Content"). By posting Your Content, you agree that it complies with our Community Guidelines. You are fully liable for Your Content and agree to indemnify, defend, release, and hold ListenersConnect harmless from any claims arising in connection with Your Content.
Please do not display any personal contact or banking information on your profile, whether related to you or another person. This includes names, addresses, phone numbers, email addresses, URLs, and banking details. If you choose to share personal information with other users, you do so at your own risk. We recommend exercising the same caution online as you would in other situations.
As Listeners Connect is a public platform, Your Content may be visible to users globally. Before posting, ensure you are comfortable with Your Content being viewed by others, including those who may receive a link to your profile or shared content. By uploading Your Content to Listeners Connect, you grant ListenersConnect a non-exclusive, royalty-free, perpetual, worldwide license to use, edit, copy, modify, adapt, translate, reformat, create derivative works from, incorporate into other works, advertise, distribute, and make available Your Content to the general public in any format or medium, now known or developed in the future.
We may assign and/or sublicense this license to our affiliates and successors without needing further approval from you.
Please note that we are not obligated to store Your Content—if it's important, keep a copy.
To protect Your Content from unauthorized use by others, you authorize us to act on your behalf concerning infringing or unauthorized uses, including sending takedown notices (such as DMCA Takedown Notices) if Your Content is used without your consent.
Member Content
Content shared by other Listeners Connect users ("Member Content") belongs to the user who posted it. Member Content is stored on our servers and displayed through the Listeners Connect app as directed by the user.
You do not have rights to other users' Member Content and may only use it to the extent that it aligns with Listeners Connect's purpose of facilitating meaningful connections. You are prohibited from using other users' information for commercial activities, sending spam, harassment, stalking, or making illegal threats. Misuse of user information may result in the termination of your account.
Member Content is subject to the terms of the Digital Millennium Copyright Act (DMCA). If you have a concern regarding Member Content, please refer to the DMCA section outlined below for further guidance.
Our Content
All other content on Listeners Connect, including text, graphics, user interfaces, trademarks, logos, sounds, artwork, software, and databases, is owned, controlled, or licensed by ListenersConnect. This content ("Our Content") is protected by copyright, trademark, database rights, and other intellectual property laws.
We grant you a non-exclusive, limited, personal, non-transferable, revocable license to access and use Our Content under the following conditions:
You may not use, sell, modify, or distribute Our Content except as permitted by the app's functionality. You may not use our name in metatags, keywords, or hidden text. You are not permitted to create derivative works from our content, nor may you scrape, disable, decompile, or use it for commercial purposes in any form. You are allowed to use our content solely for legal purposes. We reserve all other rights.
No Obligation to Pre-Screen Content
Although we are not required to pre-screen Your Content or Member Content, we reserve the right to review, screen, reject, or remove any content, including direct message exchanges, to maintain user safety and uphold compliance with these Terms.
Use of Recommender Systems
Listeners Connect uses sophisticated matching algorithms to predict compatibility between users and suggest potential matches. For more information on how these recommender systems work and the main parameters we use, please refer to our Privacy Policy.
Inappropriate Content and Misconduct Reporting
ListenersConnect is dedicated to fostering a positive and respectful community. We have zero tolerance for inappropriate content or misconduct, whether it occurs on or off the Listeners Connect platform (including services operated by our affiliates).
If you encounter any inappropriate content or behavior from other users, we encourage you to report it. You can easily report a user directly through the "Report User" link available on their profile or within the messaging interface. Additionally, you can contact our Customer Support team to report any concerns.
As described in our Privacy Policy, we may share information with our affiliates to help maintain the safety and security of our users. If we determine that you have violated these Terms, we may take necessary actions, including banning you from Listeners Connect and/or our affiliates' services. This could include preventing you from creating new accounts across our network of services. For more details, kindly refer to our Safety page.
You acknowledge and agree that, for the safety and privacy of our community, we may not share information about your account if doing so could compromise the security of other users.
Intellectual Property Concerns
If you believe that Member Content on Listeners Connect infringes upon your intellectual property rights, you may file a complaint under the Digital Millennium Copyright Act (DMCA). Please see Section 12 (Digital Millennium Copyright Act) below for detailed instructions on submitting a complaint.
Privacy
At ListenersConnect, your privacy is of utmost importance to us. We have a dedicated Privacy Policy that outlines how we collect, use, and share your personal data. To understand how Listeners Connect and its affiliates handle your personal information, please read our Privacy Policy. By using Listeners Connect, you agree that your personal data will be processed in accordance with our Privacy Policy.
Payment Terms
General Terms
Listeners Connect may offer various products and services for purchase within the app ("In-App Purchases"). By choosing to make an In-App Purchase, you acknowledge and agree to any additional terms that are disclosed at the time of purchase, which are incorporated into these Terms by reference.
You can make an In-App Purchase using the following payment methods ("Payment Method"): (a) via a third-party platform such as the Apple App Store or Google Play Store ("Third-Party Store"), or (b) by paying with your credit card, debit card, or PayPal account, processed by a third-party payment processor. When you make an In-App Purchase, you give us permission to charge your selected payment method. If we do not receive payment through your chosen Payment Method, you agree to promptly pay all amounts due upon our request.
Subscriptions and Auto-Renewal
Listeners Connect may offer services as automatically-renewing subscriptions, such as weekly, monthly, or three-month subscriptions ("Premium Services"). IF YOU PURCHASE AN AUTOMATICALLY RENEWING SUBSCRIPTION, IT WILL RENEW AT THE END OF THE SUBSCRIPTION PERIOD UNLESS YOU CANCEL IT, AT LISTENERS CONNECT'S THEN-CURRENT PRICE FOR SUCH SUBSCRIPTIONS. To avoid being charged for a new subscription period, you must cancel before the end of the current subscription period. Removing your account or uninstalling the app from your device does not automatically cancel your subscription. You will be informed of any price adjustments for the Premium Services you are subscribed to, and you'll have the option to cancel if desired. If you do not cancel, you agree that your payment method will be charged at the updated price.
Cancelling Subscriptions
If you purchased a subscription directly from Listeners Connect, you can cancel or change your Payment Method via the payment settings under your profile. If your subscription was made via a third-party platform, like the Apple App Store or Google Play Store, you'll need to manage and adjust your subscription through your account with that specific platform. If you cancel your subscription, you can continue to use it until the end of the period you last paid for; however, (i) you will not receive a prorated refund (except as noted in the "Refunds" section below), (ii) your subscription will not renew after the period ends, and (iii) You will lose access to any Premium Services or In-App Purchases associated with your subscription once it is canceled or expires.
Because you can still use our Services without a subscription, canceling your subscription does not remove your profile from our Services. To completely terminate your account, you need to follow the account termination steps outlined in Section 15.
Pricing and Promotions
Listeners Connect operates as a global service, and pricing may vary based on several factors, including region, length of subscription, and promotional offers. We may offer promotional rates that vary by region, subscription length, bundle size, and other factors. Listeners Connect reserves the right to limit the availability of, or discontinue, any product, feature, service, or promotion without prior notice; to impose conditions on the honoring of any coupon, discount, or promotion; and to refuse service or transactions for any user.
Free Trials
If you sign up for a free trial, it may convert into a paid subscription at the end of the trial period, and your Payment Method will be charged at the then-current rate for that subscription. After the free trial transitions into a paid subscription, it will automatically renew unless you choose to cancel it. To avoid charges for a new subscription period, you must cancel before the end of the current subscription or trial period. Deleting your account or the app from your device does not cancel your free trial. If you have already used a free trial via the Apple Store or Google Play Store, you may not qualify for another one. In such cases, you will be automatically enrolled in a subscription and charged accordingly.
Refunds
Generally, all charges for purchases are non-refundable, and there are no refunds or credits for partially used subscription periods.
For subscribers residing in specific U.S. states (including Arizona, California, Colorado, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, Rhode Island, Wisconsin), the following terms apply:
YOU, THE BUYER, MAY CANCEL YOUR SUBSCRIPTION WITHOUT PENALTY OR OBLIGATION AT ANY TIME BEFORE MIDNIGHT OF THE THIRD BUSINESS DAY FOLLOWING THE DATE OF YOUR SUBSCRIPTION (EXCLUDING SUNDAYS AND HOLIDAYS). IF YOU PASS AWAY BEFORE THE END OF YOUR SUBSCRIPTION PERIOD, YOUR ESTATE IS ENTITLED TO A REFUND OF THE PORTION OF ANY PAYMENT YOU MADE FOR THE SUBSCRIPTION THAT APPLIES TO THE PERIOD AFTER YOUR DEATH. IF YOU BECOME DISABLED (AND ARE UNABLE TO USE LISTENERS CONNECT) BEFORE THE END OF YOUR SUBSCRIPTION PERIOD, YOU ARE ENTITLED TO A REFUND OF THE PORTION OF ANY PAYMENT YOU MADE THAT APPLIES TO THE PERIOD AFTER YOUR DISABILITY, PROVIDED YOU FOLLOW THE PROCEDURE FOR REQUESTING A REFUND.
To request a refund:
If you subscribed using your Apple ID, refunds are handled by Apple, not Listeners Connect. To request a refund, go to iTunes, select your Apple ID, choose "Purchase History," locate the transaction, and click "Report Problem." You can also request assistance through Apple Support.
For all other purchases, please contact Listeners Connect Customer Support with your order number (found in your order confirmation email or Google Wallet for purchases made through Google Play). You can also send a signed and dated notice stating that you, the buyer, are canceling this agreement, along with the email address or mobile number associated with your account and your order number, to:
Taxes
The payments required under this section do not include any Sales Tax that may be due in connection with the Premium Services provided under these Terms. If Listeners Connect determines it has a legal obligation to collect Sales Tax from you, Listeners Connect will collect such Sales Tax in addition to the payments required. If any Premium Services or payments outlined in these Terms are subject to Sales Tax and you have not paid the applicable Sales Tax to Listeners Connect, you will be responsible for covering that Sales Tax, along with any associated penalties or interest, directly to the relevant tax authority.
Virtual Items
From time to time, Listeners Connect may offer the ability to purchase a limited, personal, non-transferable, non-sublicensable, and revocable license to access special limited-use features within the app, referred to as "Virtual Items." These Virtual Items can only be purchased directly through Listeners Connect or authorized partners. Virtual Items are provided to you as a limited license under this Agreement, and, unless restricted by applicable law, no ownership or title of the Virtual Items is transferred to you. Purchasing Virtual Items does not mean you acquire any ownership rights to them.
The amount of Virtual Items displayed in your account does not represent actual currency or any form of stored value. Instead, it reflects the scope of your license to use these Virtual Items within the Listeners Connect platform. There are no fees for not using Virtual Items. The license for Virtual Items will terminate either when Listeners Connect ceases to provide its services or when your account is closed or terminated. Listeners Connect may also offer Virtual Items as bonuses or as part of paid subscriptions. Virtual Items acquired during your subscription may expire when the subscription ends and may not roll over to future subscription periods. If you cancel your subscription, access to these Virtual Items may also be discontinued.
Listeners Connect, at its sole discretion, reserves the right to charge fees for access to or use of Virtual Items, and may distribute Virtual Items with or without charge. Listeners Connect may manage, regulate, control, modify, or eliminate Virtual Items at any time, including actions that may affect the perceived value or purchase price of any Virtual Items, and Listeners Connect shall have no liability to you for such actions. You may not sell, redeem, or otherwise transfer Virtual Items to any individual or entity. Virtual Items may only be redeemed through Listeners Connect's Services.
ALL PURCHASES AND REDEMPTIONS OF VIRTUAL ITEMS MADE THROUGH LISTENERS CONNECT ARE CONSIDERED FINAL AND NON-REFUNDABLE. Account Termination
If you decide to stop using Listeners Connect's Services, or if your account is terminated by us for any reason, here's what you need to know:
You can delete your account at any time by logging into the Listeners Connect app or website, navigating to the "Settings" tab, and following the instructions to delete your account. Please note that if you have any recurring subscriptions purchased through a Third-Party Store (e.g., Apple App Store, Google Play), you must manage or cancel those subscriptions directly through your Third-Party Account to avoid additional billing.
ListenersConnect reserves the right to investigate and, if necessary, suspend or terminate your account without a refund if we determine that you have violated these Terms, misused our Services, or engaged in behavior that we consider inappropriate or unlawful, whether on or off the Listeners Connect platform. We may use any legal, technological, or other means available to enforce these Terms at any time, without liability and without the obligation to give prior notice. This may include actions to prevent you from accessing our Services.
If your account is terminated by you or by Listeners Connect for any reason, these Terms will continue to apply and remain enforceable between you and Listeners Connect, and you will not be entitled to any refund for purchases made. Your information will be handled in accordance with our Privacy Policy, which outlines how data is maintained and deleted.
Termination of your account includes the removal of access to your account and any related information or content associated with your account. If your account is terminated, all provisions of these Terms that should survive termination will continue to apply, including, but not limited to, the Arbitration Agreement, ownership provisions, warranty disclaimers, and limitations of liability.
No Criminal Background or Identity Verification Checks
ListenersConnect does not conduct criminal background checks or identity verification checks on its users. While Listeners Connect aims to foster a respectful and safe user experience, we are not responsible for the conduct of any user, whether on or off the platform. It is essential to use your best judgment when interacting with others and to review our Safety Tips for guidance.
YOU UNDERSTAND THAT LISTENERS CONNECT DOES NOT PERFORM CRIMINAL BACKGROUND OR IDENTITY VERIFICATION CHECKS ON ITS USERS, NOR DOES IT INQUIRE INTO USERS' BACKGROUNDS. LISTENERS CONNECT MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE CONDUCT, IDENTITY, HEALTH, PHYSICAL CONDITION, INTENTIONS, LEGITIMACY, OR VERACITY OF USERS. However, Listeners Connect reserves the right to conduct, and you authorize Listeners Connect to conduct, any criminal background checks or other screenings (such as searches of sex offender registries) at any time using publicly available records. By sharing information, you agree to its use for the intended purpose. If Listeners Connect decides to conduct any screening through a consumer reporting agency, you hereby authorize Listeners Connect to obtain and use a consumer report about you to determine your eligibility under these Terms.
YOUR INTERACTIONS WITH OTHER USERS ARE SOLELY YOUR RESPONSIBILITY. LISTENERS CONNECT DOES NOT GUARANTEE YOUR SAFETY AND SHOULD NOT BE CONSIDERED A REPLACEMENT FOR FOLLOWING SAFETY GUIDELINES AND PRACTICING COMMON-SENSE SAFETY MEASURES. Trust your instincts and take proper safety measures when engaging with or meeting new people. Communications received through the Listeners Connect platform, including automated notifications, may originate from users engaging with the Service for improper purposes, such as fraud, abuse, harassment, or other inappropriate behavior.
While Listeners Connect strives to create a respectful and secure environment, we are not liable for the actions of users on or off the platform. You agree to exercise caution in all interactions with other users, especially if you choose to communicate outside of the platform or meet in person.
Disclaimer
ListenersConnect provides the Listeners Connect app and its services on an "as is" and "as available" basis, without any warranties of any kind, whether express, implied, statutory, or otherwise. This includes, but is not limited to, implied warranties of satisfactory quality, merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by applicable law, Listeners Connect makes no representations or warranties about the content, features, or Member Content available on the platform.
LISTENERS CONNECT DOES NOT WARRANT THAT: (A) OUR SERVICES WILL OPERATE WITHOUT INTERRUPTIONS, SECURITY ISSUES, OR ERRORS; (B) ANY DEFECTS OR ISSUES WILL BE IDENTIFIED OR FIXED; OR (C) THE CONTENT OR INFORMATION YOU ACCESS THROUGH OUR SERVICES WILL BE ACCURATE, COMPLETE, UP-TO-DATE, OR FIT FOR YOUR INTENDED USE. Additionally, Listeners Connect makes no guarantees regarding the number of active users, the likelihood of users communicating with or meeting you, or the compatibility or conduct of users you connect with through the platform.
You are solely responsible for how you interact with other users. Listeners Connect does not assume any responsibility for the content posted, sent, received, or acted upon by you, another user, or any third party through our Services. Listeners Connect also disclaims any responsibility for the identity, intentions, legitimacy, or accuracy of any users with whom you may interact through the platform.
Any content you download or acquire through our Services is accessed at your own risk and discretion. Listeners Connect is not responsible for any damage to your devices, software, or other technology, including but not limited to, damage resulting from security breaches, viruses, bugs, tampering, hacking, fraud, errors, omissions, interruptions, defects, delays in operation or transmission, network failures, or any other technical or operational issues.

Additionally, our Services may allow you to watch advertisements in exchange for Virtual Items. However, Listeners Connect does not guarantee that such advertisements will always be available or that you will be eligible to watch them.
Listeners Connect may also provide non-commercial links or references to third parties within its content. Listeners Connect is not liable for the availability or content of external websites or resources. Furthermore, Listeners Connect does not endorse and is not liable for any products or services offered by third-party websites or resources. If you choose to interact with third parties made available through our Services, be aware that their terms and conditions will govern your relationship with them. Listeners Connect is not liable for the actions, policies, or services of third-party providers.
Third-Party App Store
If you download the Listeners Connect app from a Third-Party Store, such as the Apple App Store or Google Play Store, the following additional terms and conditions apply. In cases where these terms are less restrictive or conflict with the terms of the Third-Party Store, the more restrictive or conflicting terms will apply specifically concerning the App and the Third-Party Store.
These Terms are between you and ListenersConnect, not with the provider of the Third-Party Store. ListenersConnect is solely responsible for the Listeners Connect app and its content. If there is a conflict between these Terms and the Third-Party Store's terms of service, the Third-Party Store's terms will take precedence. The Third-Party Store provider has no obligation to provide maintenance or support for the Listeners Connect app. ListenersConnect is solely responsible for any product warranties, express or implied by law. The Third-Party Store provider has no warranty obligations regarding the Listeners Connect app, and any claims related to failure to conform to any warranty are the sole responsibility of ListenersConnect. ListenersConnect, not the Third-Party Store provider, is responsible for addressing any claims related to the Listeners Connect app or your use of it. This includes, but is not limited to, product liability claims, compliance with legal or regulatory requirements, claims under consumer protection laws, and intellectual property infringement claims. The Third-Party Store provider and its affiliates are beneficiaries of this agreement. By accepting these Terms, you grant the Third-Party Store provider the right to enforce these Terms against you as a third-party beneficiary. In the event of a conflict between the terms and conditions of a Third-Party Store or mobile carrier and these Terms, the Third-Party Store or mobile carrier's terms will govern. ListenersConnect is not responsible and has no liability for third-party goods or services obtained through a Third-Party Store or mobile carrier. We encourage you to thoroughly investigate any online transactions with third parties before proceeding.
Limitation of Liability
To the fullest extent permitted by applicable law, ListenersConnect, its affiliates, employees, licensors, or service providers will not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, fixed, or enhanced damages, including, without limitation, loss of data, income, profits, goodwill, or any other intangible losses arising from or related to:
Your access to or use of, or inability to access or use, the Listeners Connect app or Services. The conduct or content of any users or third parties on or through the Listeners Connect platform or any of its affiliates' services. Any unauthorized access, use, or alteration of your content, even if Listeners Connect has been advised of the possibility of such damages.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LISTENERS CONNECT'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE TOTAL AMOUNT PAID BY YOU TO LISTENERS CONNECT FOR THE SERVICES DURING THE TWENTY-FOUR (24) MONTH PERIOD IMMEDIATELY PRECEDING THE DATE YOU FIRST FILE ANY LAWSUIT, ARBITRATION, OR OTHER LEGAL PROCEEDING AGAINST LISTENERS CONNECT. This limitation of liability applies (i) regardless of the legal grounds on which liability is based (whether in contract, tort, statute, or otherwise), (ii) irrespective of the type of breach of rights, obligations, or privileges, and (iii) in relation to all events, services, and these Terms.
The limitations of liability outlined in this section will apply even if your remedies under these Terms fail in their essential purpose.
Some jurisdictions do not allow the limitation or exclusion of certain damages, so some or all of the limitations in this section may not apply to you.
If you become dissatisfied with the Listeners Connect app or Services in any way, your sole and exclusive remedy is to stop using the app and Services. You waive all rights to claim damages arising from your use of the Listeners Connect platform.
The limitations of liability specified herein are a fundamental part of the agreement between you and ListenersConnect and reflect a fair allocation of risk. Listeners Connect's app and Services would not be provided without these limitations. These limitations and exclusions of liability will remain in effect even if they fail to achieve their intended purpose. The foregoing does not apply to liability arising from fraud, fraudulent misrepresentations, or any other liability that cannot be limited by applicable law.
Indemnity
All actions you take and information you post on Listeners Connect remain your responsibility. As a result, you agree to indemnify, defend, release, and hold harmless ListenersConnect and its partners, licensors, affiliates, contractors, officers, directors, employees, representatives, and agents from and against any third-party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs, and expenses (including reasonable legal fees) incurred by us arising from or related to:
Any act of negligence, omission, or willful misconduct by you. Your access to and use of the Listeners Connect app. Any actions taken by you, including uploading content to the Listeners Connect app or violating these Terms. Any breach of these Terms or violation of applicable laws by you. Your actions that violate these Terms or any laws or infringe on the rights of others. Any legal claims or causes of action arising from your use of the Listeners Connect app.
Listeners Connect reserves the exclusive right to settle, compromise, or pay any and all claims or causes of action brought against us without your prior consent. If requested, you agree to fully and reasonably cooperate with us in the defense of any relevant claim.
This indemnity provision does not require you to indemnify ListenersConnect for any unconscionable commercial practices, fraud, deception, false promises, misrepresentations, or concealment, suppression, or omission of any material fact in connection with the app.
Dispute Resolution
In the unlikely event that a legal dispute arises between us, here is how ListenersConnect ("Listeners Connect") and you agree to proceed, except where prohibited by applicable law.
Any subsection in this Dispute Resolution section that is prohibited by law will not apply to users residing in that jurisdiction. For users within the EU, EEA, UK, or Switzerland, the online dispute settlement platform of the European Commission is available at Online Dispute Resolution | European Commission. Listeners Connect does not participate in dispute settlement procedures in front of a consumer arbitration entity for users residing in these regions.
A. Informal Dispute Resolution Process
If you are dissatisfied with our Services for any reason, we encourage you to contact Listeners Connect Customer Service first, so we can attempt to resolve your concerns informally. If you decide to pursue a dispute, claim, or controversy against Listeners Connect, these terms will apply. "Listeners Connect" includes our affiliates, employees, licensors, and service providers for purposes of this Dispute Resolution Process and Arbitration Procedures outlined in Section 15.
Listeners Connect values its relationship with you and seeks to resolve disputes through informal negotiations. A "Dispute" includes any dispute, claim, or controversy arising from or related to this Agreement, the Service, or our relationship with you. This definition includes claims that arose before or after the existence of this Agreement. If you have a Dispute with Listeners Connect ("Your Dispute"), you agree to first send a detailed notice ("Notice") to Listeners Connect's registered agent. Listeners Connect agrees to send a Notice to you at your most recent email address or other contact information on file. Your Notice must include:
Your full name. Information that allows Listeners Connect to identify your account, including your email, phone number, and date of birth used to register. A detailed description of your Dispute, the nature of your claim(s), the relief you seek, and a corresponding calculation of any damages.
The Notice must be signed by you for it to be effective. Listeners Connect's Notice to you will similarly include a detailed description of Listeners Connect's Dispute, if any, along with the nature and basis of the claim(s) and the relief sought.
Both parties agree to negotiate in good faith to resolve any disputes within 60 days of receiving a complete Notice. If the Dispute is not resolved within this period, either party may initiate arbitration or a small claims court action, subject to the terms below.
Any arbitration or small claims court proceedings must be preceded by this informal dispute resolution process. This process tolls the statute of limitations and any filing deadlines.
B. Individual Relief: resolving disputes individually, without class actions or jury trials.
To the fullest extent allowed by law, both you and Listeners Connect agree to waive the right to a jury trial and resolve disputes through individual arbitration, rather than through court litigation. (Except for claims brought in small claims court or individual claims of sexual assault or harassment, as specified). Additionally, both you and Listeners Connect waive the right to bring or be involved in any class action lawsuit against one another. Arbitration will focus only on the specific party seeking relief, and no collective or representative claims will be allowed.
If a court finds any part of this waiver unenforceable for a particular claim or type of relief, that claim will be handled in court, while other disputes will remain subject to arbitration. Should this section be deemed unenforceable, the entire arbitration agreement will be voided, except for the waiver of a jury trial and the requirement for informal dispute resolution.
C. Resolving Disputes via Arbitration or Small Claims Court
Any unresolved Dispute will be exclusively resolved through binding individual arbitration, except as provided. Either party may elect to have a claim heard in small claims court instead. If a small claims court request is made after arbitration has started but before an arbitrator is appointed, the arbitration will be administratively closed. The decision made by the small claims court will be considered final and binding. No small claims court determinations will have preclusive effect on any proceeding involving Listeners Connect and other parties.
Any court proceeding to enforce this Dispute Resolution section must be commenced in accordance with Section 17. If this section is unenforceable, litigation against Listeners Connect may only occur in the courts in India. You consent to these courts' jurisdiction and waive any claim of inconvenience.
D. Individual Arbitration and Mass Arbitration Protocols
This subsection applies to Disputes submitted to arbitration after completing the informal dispute resolution process and when no small claims court election is made. Arbitration between you and Listeners Connect will be conducted by Arbitration Provider in accordance with its rules. If Arbitration Provider is unable to perform, the parties will agree on an alternative. If no agreement is reached, a court will appoint an arbitration provider.
In cases of Mass Filings (25 or more similar demands for arbitration), the additional protocols in Arbitration Provider's Mass Filing Rules will apply, including bellwether proceedings for selected cases. The first set of bellwether proceedings will consist of 30 selected cases. If unresolved, further rounds will involve increasing numbers of selected cases.
E. Future Changes and Retroactive Application
This Dispute Resolution section applies to all Disputes, including those that arose before you agreed to this Agreement. You may opt out of retroactive application within 30 days by sending written notice to support@listenersconnect.com. Please include information sufficient to identify your account(s). Opting out does not affect future Disputes. If you do not opt out, this section will apply retroactively.
Governing Law
The laws of India will apply to any Dispute arising out of or relating to this Agreement or our Services, except where prohibited by law.
ListenersConnect is incorporated in India, and any disputes related to this Agreement, our Services, or the Dispute Resolution Process detailed in Section 15, will be governed by the laws of India, excluding any conflict of law rules.
In the EU and EEA, the choice of Indian governing law shall not apply where a mandatory consumer protection law explicitly prohibits such choice of law provisions.
Venue/Forum Selection
To the fullest extent allowable by law, any claims that are not subject to arbitration must be litigated in India (except for claims filed in small claims court or for users residing in jurisdictions where prohibited by law).
Except where prohibited by law, including for users residing in the EU, EEA, UK, Switzerland, or other jurisdictions with specific legal provisions, and except for claims heard in a small claims court as outlined in Section 15, any claims arising out of or relating to this Agreement, our Services, or your relationship with ListenersConnect that are not subject to arbitration or small claims court will be litigated exclusively in the courts of India. You and ListenersConnect consent to the exercise of personal jurisdiction by the courts in India and waive any claim that such courts constitute an inconvenient forum.
Indemnity by You
You agree to indemnify, defend, and hold harmless ListenersConnect, its affiliates, and their respective officers, directors, agents, and employees from any claims arising from your actions.
To the fullest extent permitted by applicable law, you agree to indemnify, defend, release, and hold harmless ListenersConnect, our partners, licensors, affiliates, contractors, officers, directors, employees, representatives, and agents from and against any third-party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
Any careless actions, failures to act, or intentional wrongdoing on your part; Your access to and use of the Listeners Connect app; The uploading or submission of content to the Listeners Connect app by you; Any violation of these Terms committed by you; and/or Your violation of any law or infringement of a third party's rights.
ListenersConnect reserves the exclusive right to settle, compromise, and pay any and all claims or causes of action brought against us without your prior consent. If requested, you agree to fully cooperate as required by us in the defense of any relevant claim.
This indemnity provision does not require you to indemnify ListenersConnect for any unconscionable commercial practice, fraud, deception, false promise, misrepresentation, or concealment, suppression, or omission of any material fact in connection with the app.
Acceptance of Terms
By using the Services provided by ListenersConnect, you accept and agree to be bound by the Terms of this Agreement.
By using our Services through a mobile device, app, or computer, you agree to the following terms:
(i) These Terms, as amended from time to time; (ii) Our Privacy Policy, Cookie Policy, Community Guidelines, and Safety Tips; (iii) Any Additional Terms Upon Purchase.
These terms are a condition of using our services.
The pronouns used in this Agreement are intended to apply to all genders and may be singular or plural, depending on the context.
ListenersConnect is registered in India, and the laws of India will apply.
Entire Agreement
This Agreement represents the complete and final understanding between you and ListenersConnect, superseding all prior agreements and representations.
These Terms, along with our Privacy Policy, Cookie Policy, Community Guidelines, Safety Tips, and any Additional Terms Upon Purchase, constitute the entire agreement between you and Listeners Connect regarding the use of our Services. This Agreement overrides any previous agreements, representations, or arrangements, whether written or oral.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue to be fully effective. The failure of ListenersConnect to exercise or enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
You acknowledge that your Listeners Connect account is non-transferable, and all rights to your account and its contents will end upon your death, unless otherwise required by law. Any rights and licenses granted under this Agreement may not be transferred or assigned by you but may be assigned by us without restriction.
No agency, partnership, joint venture, fiduciary relationship, or employment is created as a result of these Terms, and you may not make any representations on behalf of or bind ListenersConnect in any manner.
Special Terms for Residents of Certain Locations
Special terms apply to users residing in specific regions, including Israel, Denmark, Arizona, California, Colorado, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, Rhode Island, and Wisconsin.
For Users Residing in New York:
The Services provided by Listeners Connect do not guarantee any specific number of "referrals." Instead, users can browse as many profiles as they wish based on the available functionality of the Services. Subscribers may place their subscription on hold for up to one year by providing written notice to ListenersConnect. Details on how your information is used and how you can access it are outlined in Section 5 of this Agreement and our Privacy Policy. You may review the New York Dating Service Consumer Bill of Rights for more information.
For Users Residing in North Carolina:
You may review the North Carolina Buyer's Rights for additional protections and rights.
The following applies to users located in Illinois, New York, North Carolina, and Ohio:
Listeners Connect's Services are widely available. If you believe that you have moved outside a location where we provide Services, please contact us in writing, and we will work with you to provide alternative services or a refund.
For Users Residing in Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, Rhode Island, and Wisconsin:
Your Right to Cancel: You may cancel your subscription without penalty or obligation at any time before midnight on the third business day following the date you subscribed. If you pass away before the end of your subscription period, your estate is entitled to a refund for the portion of any payment made that is applicable to the period after your death. If you become disabled and are unable to use our Services before the end of your subscription period, you are entitled to a refund for the portion of any payment made that is applicable to the period after your disability. To request a refund, please follow the procedure outlined in Section 8.
For Users Residing in Denmark:
If you wish to exercise your right of cancellation, you may complete and send the standard form of cancellation provided in the Appendix. Note: If you purchased your subscription through Apple, termination or cancellation must be directed to Apple. Exception to the Right of Cancellation: You cannot cancel an order that includes the delivery of digital content not delivered on a physical medium if processing has begun with your express prior consent, acknowledging that you waive your right of cancellation. This applies to purchases such as Virtual Items, which are FINAL AND NON-REFUNDABLE.

This clause does not limit or exclude liability for fraudulent misrepresentation.
ListenersConnect has made reasonable efforts to ensure the accuracy, availability, and completeness of the information presented on Listeners Connect. All information is provided on an "as is" and "as available" basis, with no express or implied warranties or representations about the information on Listeners Connect. Your use of Listeners Connect and the content provided is at your own risk. ListenersConnect is not responsible for any loss or damage resulting from the transmission or use of data or any inaccurate content provided by members.
You are responsible for taking necessary precautions to ensure that any material obtained from Listeners Connect is free of viruses or other harmful components. While we strive to keep Listeners Connect operational and free from errors, we do not guarantee uninterrupted service or the correction of defects. We are not responsible for any damage to your computer hardware, software, or other equipment resulting from any security breach, virus, bug, tampering, fraud, error, or any other technical issue related to your use of Listeners Connect.
Communication between you and ListenersConnect may occur via electronic means, such as emails or in-app notifications. By using Listeners Connect, you (a) consent to receive communications from us electronically, and (b) agree that all terms, conditions, agreements, notices, and disclosures provided electronically satisfy any legal requirement that such communications be in writing. This does not affect your statutory rights under applicable law.
Changes to Terms
As Listeners Connect evolves, we may need to update these Terms. We retain the right to revise, update, or alter these Terms at any time ("Modifications"). Any Modifications will be posted on this page, with the Effective Date of the changes clearly noted. In certain cases, we may notify you of changes via email. We may also request your agreement to the updated Terms.

Additional Terms
If any provision of these Terms is found to be illegal, invalid, or otherwise unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining Terms shall remain in full force and effect.

You are not located in a country subject to an Indian Government embargo or designated as a "terrorist supporting" country; You are not listed on any government list of prohibited or restricted parties.
Listeners Connect is a global platform operating through servers located in various countries, including India. By submitting your personal information, upgrading services, or using Listeners Connect's applications, you consent to the transfer, storage, and processing of your information in any such countries.
Listeners Connect may include links to external websites or resources. You understand and accept that we are not responsible for the availability, accuracy, content, products, or services found on these third-party sites. The inclusion of these links does not signify Listeners Connect's endorsement of them. You assume all risks associated with using these third-party websites or resources. Framing, in-line linking, or other associations with Listeners Connect are prohibited without our prior written consent.
These Terms, and any rights or licenses granted under them, may not be transferred or assigned by you but may be assigned by us without restriction.
If there are conflicts between the English version and any translated versions, the English version will take precedence.
